By creating an account, signing up for our waitlist, or using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Description of Service

HomeTrackers is a home maintenance tracking platform that allows users to:

• Track and organize home repairs, maintenance, and service history
• Store warranty information and important documents
• Receive maintenance reminders and recommendations
• Manage contractor information and service provider details
• Access AI-powered insights about home maintenance and warranties

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

5. Subscription and Payment Terms

HomeTrackers offers subscription-based access to premium features:

Pricing

• Homeowner Plan: $4.99/month or $49/year (save 18%)
• Landlord Plan: $9.99/month or $99/year (save 17%)

All prices are in US dollars and subject to applicable taxes.

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Your subscription will automatically renew unless you cancel before the renewal date
• Payment is processed securely through our third-party payment processor
• You authorize us to charge your payment method for all fees incurred

Cancellation and Refunds

• You may cancel your subscription at any time
• Upon cancellation, you will retain access until the end of your current billing period
• We do not provide refunds for partial subscription periods
• Annual subscribers may request a prorated refund within 30 days of purchase

6. Intellectual Property

The Service and its original content, features, and functionality are owned by HomeTrackers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit to the Service (including property data, documents, and photos). By submitting content, you grant us a limited license to store, process, and display that content solely to provide the Service to you.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Violation of applicable laws
• Fraudulent, abusive, or illegal activity
• Non-payment of applicable fees
• Extended period of inactivity

Upon termination, your right to use the Service will cease immediately. You may request a copy of your data within 30 days of termination.

8. Limitation of Liability

To the maximum extent permitted by law, HomeTrackers and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to or use of our servers or your personal information
• Any damages resulting from interruption or cessation of the Service
• Any damages resulting from third-party conduct on the Service

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to:

• Warranties that the Service will be uninterrupted or error-free

HomeTrackers does not provide professional home inspection, maintenance, or warranty advice. The Service is for informational and organizational purposes only. Always consult qualified professionals for home maintenance decisions.

10. Indemnification

You agree to defend, indemnify, and hold harmless HomeTrackers and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you submit to the Service

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Multnomah County, Oregon. You consent to the personal jurisdiction of such courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Sending an email notification for significant changes (for registered users)

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
